Job summary

This post is suitable for a registered nurse, AHP or social worker who will act as a clinical expert for all aspects around Mental Capacity, and provide core leadership, training, and support staff in applying the principles of Mental Capacity Act (2005) and Deprivation of Liberty Safeguards (2007); the Care Act (2014) and Liberty Protection Safeguards (2020).

The primary purpose of the role is to ensure that patients who lack capacity to consent to care or treatment who need to access acute health care services, receive the highest possible standard of care.

The post holder will actively promote and facilitate evidence based practice and quality assurance within the Trust, raising the profile of patients who cannot consent to care or treatment within the Trust.

The MCA / DoLS / LPS Lead Practitioner will be located within the Safeguarding Adults Team. The role requires a professional with excellent team working and communication skills; you will provide patient centered care and deliver effective evidence based care to a defined demographic population with diverse health care and social needs.

Main duties of the job

The successful candidate will need to be prepared to adapt to the changing needs of the Trust as they arise.

  • Highly developed knowledge and understanding of current MCA, DoLS/LPS legislation, guidance and policies from a local and national perspective including the Care Act [2014], Mental Capacity Act [2005] and Deprivation of Liberty Safeguards [2009]
  • Knowledge and understanding of anti-discriminatory practice
  • Robust knowledge in the area of safeguarding policy, guidance and legislation
  • The ability to analyse and collate complex data and to write high quality, analytical reports
  • The ability to communicate highly complex and sensitive information across a range of multi-agency stakeholders and also to families and patients
  • Ability to act as an autonomous practitioner within professional and clinical guidelines
  • Effective teaching, facilitation, assessment, and feedback skills
