Job summary

'We are looking for a highly motivated person who has excellent written and verbal communication skills and an in-depth working knowledge of Mental Health Act 1983 and Mental Capacity Act 2005 with the ability to interpret and apply it. As MHA/MCA Co-ordinator you will be responsible for supporting the administration of MHA and MCA DoLS ensuring compliance with Mental Health Law. You will be required to confidently and professionally advise, support and motivate staff and liaise with others from organisations outside the Trust. We are looking for someone who has extensive administrative experience and the skills to support the management of a small team. You will need a methodical and flexible approach, the ability to work under pressure and competence in the use of Microsoft Office applications.'

Main duties of the job

Providing support to the Mental Health Legislation team to ensure the Trust meets its statutory obligations surrounding the lawful use and management of the Mental Health Act (MHA) 1983 and Mental Capacity Act (MCA) 2005 across the Trust.

The postholder will provide support to the Deputy MH Legislation Manager/Office Manager in the smooth running of the MH Legislation Office which includes the administrative areas where applicable with work pertaining to the Mental Health Act 1983 (as amended by the 2007 Act) and Deprivation of Liberty Safeguards (DoLS) and later Liberty Protection Safeguards (LPS) part of the Mental Capacity Act, 2005 within specific London boroughs and other areas within the Trust.

The post holder will participate in the enhancement of the service including the aims, objectives and creativeness of the team.

Starting with NELFT

NELFT place a great deal of importance on new starters being properly welcomed and inducted into the Trust. All new starters will join the Trust on the first Monday of each month and will undertake a comprehensive induction of up to two weeks which will include mandatory training, systems training and the allocation of equipment. As part of the process new starters will have the opportunity to also meet the executive team, senior managers and attend a number of drop in sessions focussing in engagement, health and wellbeing and key processes. The induction will be held at our head office in Rainham, Essex.

This post also attracts payment for High Cost Area Supplement of 15% of the basic salary (with a minimum of £4,313 to a maximum of £5,436 p.a. pro rata for part time).

Job description

Job responsibilities

To be responsible to support the efficient running of the MH Legislation Office ensuring that systems and processes are maintained and contributing to development.

To provide advice on use of the MHA and MCA DoLS in some areas and seeking guidance from the Dep MH Legislation/Office Manager, or MH Legislation Manager(s) as necessary

To maintain, administer and monitor case record files and folders for detained and community patients and those subject to a DoLS (later Liberty Protection Safeguards (LPS).

To scrutinise MHA documentation, identifying any errors in the lawfulness of completion and seeking correction as well as providing guidance on correction to the MH Legislation Administrators. Where necessary escalating concerns to Dep/MH Legislation Managers

To check DoLS documentation to ensure the completed form is correct and seek appropriate correction where necessary. Raise any concerns to Dep/MH Legislation Managers.

To ensure the co-ordination of the tribunal appeals process and providing guidance to staff where necessary. Support the arrangements as necessary. Liaising with professionals (e.g. Responsible Clinicians, Social Workers (Care Co-ordinators), nurses, Tribunal staff, etc.) and ensuring that any issues are raised with the Deputy MH Legislation Manager/Office Manager or if necessary escalating to MH Legislation Managers

To co-ordinate the Hospital Managers appeals and review process and support hearing arrangements where necessary. Liaise with the Associate Hospital Managers and staffas necessary and raising any issues with the Dep/MH Legislation Managers

To ensure the maintenance and monitoring of the MHA and DoLS electronic systems.Including the patient record (RiO and Caredoc), email inbox(s).

To observe the office environment ensuring that health and safety, fire regulations etc. are maintained and any issues brought to the attention of the Dep/ MH Legislation Manager(s)

To manage and provide supervision, appraisal and direction to B4 MH Legislation Administrators where appropriate with regard to MHA and DoLS administrative work and where directed by Dep/MH Legislation Managers

To provide support and work closely with the Deputy/MH Legislation Managers byproviding IT, statistical and other information/data as necessary
